Service Disputes
As a consumer it is important to note that when you are paying for a service, you expect to have the job done to a reasonable standard. This means that the service should be completed
- With reasonable care and skill. For instance if you pay for a new extension to your house you would not expect the walls to start cracking
- If you have agreed a set competition time, the service should be completed within this time frame. If you have not agreed on a set time period the work should be completed within a reasonable time period
- The service should be carried out for a reasonable charge, if the price was not fixed beforehand. If the price was agreed beforehand, you will not be able to claim later that the fee is unreasonable
Building Works
Service disputes can be quite a common occurrence for consumers, however the most commonly affected trades are those surrounding building work, plumbing and window installation.
If you find yourself having a dispute with your builder, and your claim is above the small claims court limit of £5000, then taking legal advice will be the most appropriate step. Seeking legal advice is important as you will have to be prepared to pay the builder's legal costs if you happen to lose. On some occasions it may not immediately be clear who is responsible for the problem. Should this be the case, action would normally be taken against any sub-contractors used by the builder. Furthermore if you have paid by credit card or arranged a credit agreement, you may also have a claim against the credit provider.

Before you depart with your well earned money, it would be advisable that you do some preparation in advance to avoid facing trouble later. Take notes of quotes and completion dates. Ensure that you are happy with the quality of service you received before departing with your cash.
