Fatal Crash in Cornwall - Passenger Compensated
22nd February 2010
In October 2003, labourer and bricklayer Anthony Bennett (aged 26) from Dobwalls and his friend Jonathan Stephens were involved in a fatal car accident that left the driver (Stephens) dead and Anthony Bennett (a back seat passenger) severely disabled. The car crash that has left Bennett a paraplegic happened on the A390 near Liskeard in Cornwall.
Lawyers for Bennett were getting ready to take the claim to court where they would argue that Stephens who was driving the vehicle was at fault when the accident took place as he did not take appropriate action to avoid an obstruction in the road. A settlement was reached however before the matter went to court, with Mrs Justice Sharp awarding Bennett the sum of around £2.25 million.
The payout is to not only cover all medical costs but also includes general compensation to compensate for the pain and suffering caused. Bennett is likely to need round the clock care for the rest of his life and has had his life severely affected by the accident as he is now in a wheelchair for the rest of his life and unable to support himself.
