How much compensation can I expect to receive?

Compensation amounts vary from case to case as they are based on the individual’s circumstances, the severity of the injury, how much life has changed for the person as a result of the injury and plenty of other factors besides. Even cases that seem to be very similar in nature can be awarded very different amounts.

Nonetheless, there are some general guidelines that can provide some idea as to the compensation amounts that can be expected as the result of a successful claim. Here is a guide to compensation amounts for common injuries:

Minor neck injury

Those with minor soft tissue damage or whiplash (usually as a result of a car accident) can expect to win up to £1000 in compensation. For settlements less than £1000 the cases are heard in a small claims court.

Broken limb such as leg or arm

When a limb is broken, particularly if the ability to work and earn money is affected a claim can be between £4,000 to £11,000.

Moderate whiplash compensation

If recovery time is between 18 months to 2 years then the injured party can expect to receive between £1000 to £5000 in compensation. If recovery time is over 2 years then the amount due increases to £8000 or even £9000.

Moderate neck injury

Injuries that include disc lesions or any other problem that leaves the neck with limited movement or mobility are worth approximately between £8,500 and £16,000.

Severe neck injuries

Fractions, dislocations and very severe neck injuries that perhaps can never be recovered from are worth from between £35,000 to £95,000. This group also includes those who develop paraplegia although these cases are very rare.

Both general compensation and special compensation can be applied for as part of the overall claim. General compensation covers the pain and suffering caused and any mental and physical problems as a result of the injury. Special compensation on the other hand covers the actual bills and costs incurred. These include medicines, care from an assistant (even a family member) or loss of earnings as a result of the injury.
