Accident Claims
More than two and a half million UK residents suffer a serious accident or injury either because of a road accident, an accident at work or in a public place. The result, for many, is financial loss and a reduction in quality of life.
If the cause of the injury is the fault of another, our team will ensure that you receive the damages you deserve. Whilst much is made in the tabloid media of a so-called "claims" culture in fact, according to independent research, only 31% of injured parties end up making a claim. The Citizens Advice Bureau notes that:
"Seeking compensation for injuries and harm is not a social problem or the sign of the emergence of a 'compensation culture,' but simply realising a civil and legal right".
The practical issue for many accident victims without legal or fiscal resource is how they can effectively, and without cost pursue a case. That is where we can help. Call our helpline on a 0330 330 9154. All calls are confidential and you are under no obligation to take up our legal services.
No fee no win
Q. How much will this cost?
A. Nothing, call our helpline and we will assess your claim and advise you whether you have a valid case.
If, in the unlikely event, our solicitor's pursue your case but are unsuccessful, you do not pay a penny.
More properly known as a conditional fee agreement, a no-win-no-fee agreement means your solicitor agrees to act on your behalf but will not charge you should you lose. The promotion of No fee no win arrangements by the government as a way to reduce the cost of legal aid has meant that accident claims are now most frequently funded by solicitors rather than the public purse.
Road Accident, Work Accident, Whiplash?
The majority of claims arise from road traffic accidents or RTAs. Each year according to MASS, the Motor Accidents Solicitors Society (MASS seeks to bring justice to road accident victims) around 700,000 road accident claims are pursued in the UK. Most are settled by the fault party insurer accepting liability and offering to pay compensation to settle.
Other sources are work injuries, which frequently relate breaches of an employer's statutory duty to provide a safe working environment rather than law common negligence.
See:
An increasing number of work related cases flow from the duty of public bodies such as Councils and Boroughs and private property owners to ensure that places of public access are safe. These public place accident claims often take the form of an occupier's liability claim if the place where the accident occurs is private or for breach of statutory duty by public authorities who have a duty to maintain and make safe roads, footpaths and public buildings.
Road traffic accident claims we have handled successfully include accidents involving:
- Passenger or driver in a car/bus/taxi/plane
- Injuries involving uninsured victims and drivers
- Claims on behalf of children
- Injuries caused by defective cars and vans
- Motorbike/cyclist road traffic accidents
- Spinal injuries caused by an RTA
